I’m writing with some updates about my office’s open constituent hours, the
New York State budget, and some community events that are coming up.
*OPEN CONSTITUENT HOURS*

*THE BUDGET*
On April 1st we finalized our first state budget as a Democratic Majority.
It was a strong budget, but we have room to improve. This was the first
time Democrats have assembled a budget in decades. Governor Cuomo also had
an 8-year head-start on his own priorities. We are a new, diverse
conference trying to work together efficiently and have some growing to do
together. With that in mind, here are some highlights from the final budget
bills:
*Education*
We failed to make major gains in education funding this year despite a
strong position from the Assembly and the Senate. You may know that I won a
13-year lawsuit in 2006 that resulted in the creation of the Foundation Aid
formula to equitably fund public schools in New York State. Governor Cuomo
has again turned his back on that Court of Appeals decision; ignored the
will of millions of parents, students, and educators; and blocked the
funding our children need and deserve. In spite of his opposition to
supporting public education, the State Budget includes:
- Increasing Foundation Aid by $618m, 3.5% over the 2018–19 school year;
this is half of what the Assembly and Senate had stated in their one-house
budgets
- Providing a $15m increase to provide programs for three- and four-year
olds.
- Extending mayoral accountability of New York City schools for three
years, with reforms to enhance transparency and parental and community
input in New York City school governance.
- Authorization of “piggyback contracts” for transportation in education
by cutting the red tape that prevented school districts from working
together to save money.
- Providing $34.4m for school lunch programs and a $9m increase to
expand early college high schools.
Funding for CUNY is also, once again, inadequate. We did not even close the
gap between the Tuition Award Program and the tuition charged at CUNY
schools, which leaves the schools to pick up the tab. As our city’s best
vehicle for social mobility, CUNY deserves better.
*Housing*
Housing is a human right. I’m proud to support the fight for housing
justice within the State Budget, including:
- Implementing the Lawful Source of Income Non-Discrimination Act of
2019 to fight housing discrimination.
- Increasing funding for the Tenant Protection Unit to $5m, a 22%
increase over the current year.
- Investing $20m in foreclosure prevention services to help New Yorkers
stay in their homes.
- Restoring roughly $400m to NYCHA that the State had been withholding.
*Election and Governance Reforms*
In January 2019, I helped pass historic pro-voter bills and electoral
system reforms. The enacted State Budget continues this work, including:
- Allocating $10m in funding for early voting and $14.5m in funding for
e-poll books.
- A public financing commission with power to implement public campaign
financing for legislative and statewide offices due December 1, 2019,
binding unless modified by legislators within 20 days.
- Requiring three hours of paid time off so New Yorkers will be better
able to vote on Election Day.
- Protecting grassroots and volunteer-run organizations from being
forced to register as lobbyists.
I share the frustration of many of you that we weren’t able to pass public
financing of elections. I’m committed to making sure this commission gets
the job done so that we can go into 2020 with public financing in place.
*Small Businesses*
I support investment to assist New York businesses to grow, create jobs,
and be successful. The enacted State Budget includes:
- Allocating $365,000 for the Minority and Women Owned Business
Development and Lending Program.
- Investing $4 million for the Workforce Development Institute.
- Major investments to steer state and local resources to community
banks and credit unions, which will help provide additional lending access
to underserved communities.
*Healthcare*
Everyone deserves access to quality healthcare. I understand this fact and
worked to ensure that the State Budget provides essential funding for New
Yorker’s health care needs and essential medical care providers. The
enacted State Budget includes:
- Implementing the federal Affordable Care Act and the New York Health
Care Exchange into State law.
- Investing $100 million in OASAS to better confront the opioid abuse
crisis.
- Requiring health insurance companies to increase the length of time
available for New Yorkers seeking in-patient treatment for substance abuse
disorders.
- Providing over $3.8 million for School Based Health Clinics.
- Investing significant state funds for research and programs to combat
diseases including Sickle Cell, Alzheimer's, Parkinson's, and Lupus.
We did well this year but missed the mark by failing to include safe
staffing requirements. Single payer healthcare is also a goal of mine.
*Environment*
Climate justice is a major fight for me, representing a majority minority
and working-class district geographically vulnerable to climate change. I’m
proud that the enacted State Budget includes:
- Banning single-use plastic bags
- Providing an historic level of funding for the Environmental
Protection Fund of $300m.
- Enacting congestion pricing around the Central Business District of
Manhattan. Carve-outs currently include the West Side Highway, FDR Drive,
emergency vehicles, folks within the Central Business District making less
than $60,000/year, residential vehicles only once a day, seniors, and
people with disabilities. Any other exemptions will be at the hands of the
commission formed.
*Criminal Justice Reform*
I’ve long supported dismantling the prison pipeline, and the presence of
these reforms in the Revenue budget led me to vote “yes” despite the lack
of education funding. The enacted budget includes:
- Eliminating cash bail for misdemeanors and non-violent felonies to
ensure that no New Yorker is incarcerated because of their inability to
pay. Additionally, law enforcement officials will be required to issue a
desk appearance ticket to most people charged with misdemeanors and Class E
felonies.
- Requiring misdemeanors be resolved within 90 days, felonies within 180
days; requiring courts advise litigants on how time will be charged and
inquire into the government’s readiness to proceed to trial; and requiring
the government file all suitable paperwork before statement of readiness is
accepted.
- Requiring that both prosecutors and defendants share all information
in their possession well in advance of trial, and ensuring that both
victims and witnesses are protected from intimidation and other forms of
coercion by providing prosecutors the ability to petition a court for a
protective order.
*Census 2020*
The Governor blocked the full funding of $40m requested for the 2020 Census
to be done properly in New York State, resulting in only $20m set aside for
this crucial endeavor. We must count everybody!
*Red Light Cameras*
We extended the red light camera program until December 2024, with
approximately 150 red light cameras in NYC. The program was also expanded
to other cities such as Albany, Mt. Vernon, New Rochelle, White Plains,
Yonkers, Nassau County, and Suffolk County.

*EL PRESUPUESTO*
El 1 de abril llevamos al cabo nuestro primer presupuesto como mayoría
Demócrata. Es un presupuesto fuerte, pero podemos mejorar el proceso para
el año que viene. Fue la primera vez que lxs Demócratas montaron un
presupuesto hacía décadas. Además, el Gobernador Cuomo tenía ocho años de
ventaja para sus propias prioridades. Somos una conferencia nueva y
diversa, intentando trabajar juntxs eficientemente, y tenemos que crecer
con el paso de tiempo. Teniendo eso en cuenta, se ven algunos puntos claves
sobre la legislación final del presupuesto:
*La Educación*
Fallamos en lograr aumentos importantes en el financiamiento de educación
este año a pesar de una posición muy fuerte de la Asamblea y el Senado. Tal

el presupuesto del estado incluye:

En enero de 2019, ayudé aprobar legislación histórica que reformó el
sistema electoral. El presupuesto del estado continúa este trabajo,
incluyendo:
- Otorgando $10 millones para la votación temprana y $14.5 millones para
libros de encuestas eletrónicos.
- Una comisión sobre financiamiento público con el poder de implementar
financiamiento público para campañas en oficinas legislativas y estatales
que debe someter sus conclusiones el 1 de diciembre 2019, las cuales son

financiamiento público asegurado.
*Pequeños Negocios*
Yo apoyo invertimiento para ayudar negocios de Nueva York crecer, crear
puestos de trabajo, y tener éxito. El presupuesto del estado incluye:
- Destinando $365,000 para el Programa de Desarrollo y Préstamos para
Negocios de Mujeres y Minorías.
- Invirtiendo $4 millones en el Instituto de Desarrollo de Personal.
- Inversiones importantes para guiar recursos del estado y municipios a

*La Salud*

proveedores médicos. El presupuesto incluye:

*El Medio Ambiente*
La justicia climática es una lucha importante para mi como representante de
un distrito de clase trabajadora con mayoría minorías que es vulnerable al
cambio climático. Me siento orgulloso que el presupuesto del estado incluya:
- Prohibición de bolsas plásticas de un solo uso
- Brindando un nivel histórico de financiamiento para el Fondo de
Protección Medio Ambiental de $300 millones.
- Implementando impuestos de tráfico sobre el Distrito Central de
Manhattan. Exclusiones actualmente incluyen la carretera del lado oeste,
FDR Drive, vehículos de emergencia, personas quienes viven en el Distrito
Central y ganan menos de $60,000 al año, vehículos residenciales una vez al
día, ancianxs, y gente con discapacidades. Otras exclusiones se consideran
por la comisión que formó.
*Reformas Del Sistema de Justicia Criminal*
Hace mucho tiempo que apoyo el descomponimiento del ducto de la cárcel, y
la presencia de estas reformas en el presupuesto de Ingreso me hizo votar
“sí” a pesar de la carencia de financiamiento para educación. El
presupuesto incluye:
- Eliminación de fianza en efectivo para delitos menores y delitos
graves no-violentes para asegurar de que ningune Neoyorquine no se
encarcele por falta de pago. Además, se requiere que agentes de policía
distribuyan un “desk appearance ticket” a la mayoría de la gente acusada de
delitos menores y delitos mayores de clase E.
- Requiriendo que delitos menores se resuelven entre 90 días, delitos
mayores entre 180 días; requiriendo que las cortes avisen a lxs litigantes
sobre como se asignan tiempo e investigue la preparación del gobierno para
proceder al juicio; y requiriendo que el gobierno entregue el papeleo
apropiado antes de que se acepte un anuncio de preparación.
- Requiriendo que abogadxs de la acusación y el defenso comparten toda
la información que poseen antes del juicio, y asegurando de que se protegen
víctimas y testigos de intimidación y otras formas de coacción a través de
dando a lxs fiscales la oportunidad de solicitar de la corte una orden de
protección.
*El Censo de 2020*
El Gobernador bloqueó el financiamiento completo de $40 millones para que
se haga el censo de 2020 correctamente en el Estado de Nueva York; el
resuelto es que solo hay $20 millones brindado por este esfuerzo tan
importante. ¡Tenemos que contar a todxs!
*Cámeras de Luces Rojas*
Extendimos el programa de cámeras de luces rojas hasta diciembre de 2024,
con aproximadamente 150 cámeras en la Ciudad. Se expandió el programa a
otras ciudades también, incluso Albany, Mt. Vernon, New Rochelle, White
Plains, Yonkers, Nassau County, y Suffolk County.
