A Note from Assembly Member O'Donnell

As our weather continues to heat up, I hope everyone has been able to stay cool!
 In recent weeks, I've been contacted by many constituents concerned about Assembly
bill A10798, and I would like to share my thoughts and actions on the legislation.
A number of individuals have called or written me to voice support for the bill 
because it contains a large, crucial tax abatement for the many co-op and condo 
owners in our community and throughout New York City. However, I have also heard
 much opposition to the bill because it also extends the J-51 tax abatement for 
landlords.

For this reason, I wrote to Speaker Silver on June 26th to strongly express my belief
that additional, strengthened protections for tenants must be added to the legislation
before we return to Albany to act on the bill. These safeguards include reforms 
of the Rent Guidelines Board to make it more accountable, inclusion of rent controlled
tenants under the Rent Guidelines Board for lease renewal increases, protection 
for tenants with "preferential rents" from large increases, and a significant readjustment
for how to deal with Major Capital Improvement Increases. I am hopeful that A10798
will be amended and I will continue to push for these vital measures for tenants
 to be included. If you would like a copy of my letter, please feel free to contact

On a related note, I am proud that on June 13, 2012, the Assembly passed my bill,
A2459a, which would ensure that once the cost of a Major Capital Improvement (MCI)
is recovered by a landlord, any associated rent surcharge will immediately end. 
However, the State Senate again refused to take up this important legislation, letting
the bill die in the Senate Committee on Housing.

Additionally, I'm very pleased to announce that as of July 1st, my anti-bullying
 legislation titled the Dignity for All Students Act (DASA), is now in effect across
New York State. It requires that all public schools implement anti-bullying policies
and helps ensure that our schools afford all public school students an environment
free of harassment and discrimination. Governor Cuomo also recently signed into 
law my cyberbullying addition to DASA, which extends these protections to cyberspace.
